Samsung’s company ex-head will return to prison
Lee Jae-yong is going to return to jail following the court decision that he is responsible for bribing an ex-president of South Korea Park Geun-hye, an impeachment to whom was proclaimed in 2017.
The sentence is defined as 2.5 years. Mr. Lee Jae-yong still can take the deal to the Supreme Court of the country, the decision of which, according to South Korean rules, cannot overrun the decision of the underlying court. In this case, the decision can be lowered in severity or sent back to reconsideration to the previous court. That means that no matter what Mr. Lee Jae-yong will now do from the legal point of view, the prison sentencing is still taking place, and the 2.5-year term is unlikely to be lowered (but it can be bigger).
There is a possibility, though, that the deal will reach the Supreme Court, as it already happened in 2019 when the case of Mr. Lee Jae-yong was considered for the first time. Then, it was ruled out to reconsider the deal because the bribery amount was underestimated – instead of 3.6 billion won, it was 8.6 ($7.8 million).
As Mr. Lee Jae-yong has already been jailed for 1 year since the moment of his arrest in 2017, he will only have to undergo incarceration for 1.5 years. His repeated arrest was made on the premise of the court, which adopted the decision today, on Monday, 18th of January 2021.
